By accessing or using the website at milpitasmasonry.com, requesting a quote, scheduling a service, or engaging Milpitas Masonry & Concrete ("Company," "we," "us," or "our") in any capacity, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this website or our services.
Milpitas Masonry & Concrete provides residential and commercial masonry and concrete contracting services in and around Milpitas, CA, including foundation repair, chimney repair, tuckpointing, brick and stone work, retaining walls, driveways, walkways, fireplaces, outdoor kitchens, and related services. Service availability is subject to scheduling, permitting requirements, and project feasibility as assessed on-site.
Written estimates are provided at no charge following an on-site assessment. An estimate is not a binding contract until both parties have signed a written service agreement or work order.
Estimates are valid for 30 days from the date of issue unless otherwise stated in writing. Prices are subject to change if the scope of work changes after the estimate is issued, if unforeseen site conditions are discovered during work, or if material costs change significantly before work begins.
We will notify you in writing before proceeding with any work that would materially increase the cost above the original estimate.
Service appointments are scheduled by mutual agreement. We will make reasonable efforts to arrive within the agreed timeframe and will notify you as early as possible if circumstances require rescheduling.
If you need to cancel or reschedule a confirmed appointment, please notify us at least 48 hours in advance. Cancellations made with less than 48 hours notice for jobs where materials have already been ordered may be subject to a restocking or materials charge.
We reserve the right to reschedule work due to weather conditions, permit delays, or other circumstances outside our control. We will communicate any such delays promptly.
Payment terms are specified in the written service agreement for each project. Unless otherwise agreed in writing:
We accept payment by cash, check, or other methods specified at the time of contracting. Invoices not paid within 30 days of the due date may be subject to a late fee and may result in suspension of ongoing work.
If you dispute any portion of an invoice, notify us in writing within 10 days of receipt. We will work with you in good faith to resolve the dispute.
Many masonry and structural projects require permits from local building authorities. Where required, we will apply for and manage the permit process as part of the project scope. Permit fees are the responsibility of the property owner and will be itemized separately in the written estimate. Work will not begin on permitted projects until the necessary approvals are in place.
We warrant that all work will be performed in a professional and workmanlike manner consistent with industry standards and applicable building codes in California.
Any warranty on workmanship or materials will be specified in the written service agreement. Warranties do not cover damage caused by improper use, third-party modifications, natural disasters, or conditions outside our control including soil movement, seismic activity, or extreme weather.
To the maximum extent permitted by applicable law, Milpitas Masonry & Concrete shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our website or the performance of our services, including but not limited to loss of use, loss of profits, or property damage not directly caused by our negligence.
Our total liability for any claim arising from a service engagement shall not exceed the amount paid by you for the specific service that gave rise to the claim.
The information on this website is provided "as is" without any warranties of any kind, express or implied, including warranties of accuracy, completeness, or fitness for a particular purpose. We make no warranty that the website will be uninterrupted or error-free. This disclaimer does not affect any workmanship or materials warranties provided in a signed service agreement.
If a dispute arises between you and Milpitas Masonry & Concrete in connection with these Terms or any services provided, both parties agree to first attempt to resolve the dispute through direct good-faith communication.
If the dispute cannot be resolved informally within 30 days, the parties agree to submit the matter to binding arbitration under the rules of the American Arbitration Association, conducted in Milpitas, CA. Each party bears its own costs unless the arbitrator rules otherwise.
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action not subject to the arbitration provision above shall be brought in the courts of Santa Clara County, California.
We may update these Terms and Conditions from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the website or our services after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
